S&P Crafty Party Favors LLC — Terms of Service

These Terms of Service (“Terms”) govern your use of www.spcraftypartyfavors.com and any purchase from S&P Crafty Party Favors LLC (“S&P,” “we,” “us,” or “our”). By accessing the site or placing an order, you agree to these Terms and our Privacy Policy and Return & Order Policy.

Our store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell our products and services.

 

1) Eligibility & Conduct

You must be the age of majority in your state (or have parental consent) to use this site. You agree not to use the site for unlawful purposes, not to upload malware, and not to violate any third-party rights.

 

2) Custom Work, Proofs & Approvals

Custom nature: Most items are made to order. Please provide accurate details and deadlines when you order.

Proofs: We send a proof before printing.

Minor changes (spelling, small color tweaks, simple font changes): included.

Major changes (theme change, new photo after editing, multiple redesigns): $15+ design fee.

Approval window: You have 72 hours to approve. If we don’t hear from you, we may proceed “as-is” to meet your delivery date.

3) Processing & Shipping

Processing times (not including shipping):

Digital: ~2–5 business days

Custom physical orders: ~7–14 business days

Orders are processed in the order received. Shipping times are estimates and outside our control. Once shipped, we are not responsible for carrier delays, loss, or theft. Tracking is provided.

 

4) Pricing, Tax & Availability

Prices and availability may change without notice.

Sales tax is collected where required by law.

We may correct errors (including pricing or availability) and cancel/refund an order placed under an error.

5) Orders, Fraud Prevention & Right to Refuse

We reserve the right to refuse, limit, or cancel any order (e.g., duplicate orders, suspected resale, or fraud).

For orders of $200+, we may require a signed client agreement and photo ID matching the payment method (or offer Zelle as an alternative). Orders with mismatched or unverifiable information may be canceled and refunded.

 

6) Payment & Third-Party Processors

Payments are processed securely via Shopify Payments, Stripe, PayPal, and/or Cash App. We do not store full card numbers. Your use of a payment provider is subject to that provider’s terms.

 

7) Digital Products & License

Digital files are delivered electronically and are non-refundable.

Unless otherwise stated in the product listing, digital files are for personal, non-commercial use only. You may not resell, distribute, or claim the designs as your own.

 

8) Returns, Cancellations & Chargebacks

Custom items: No returns, exchanges, or cancellations once production begins.

Gift cards: Non-returnable.

Damages/incorrect items: Contact nique@spcraftypartyfavors.com within 48 hours of delivery with photos; we’ll review and work to resolve.

Chargebacks: Please contact us first to resolve issues. Filing a chargeback without contacting us may result in refusal of future orders. Fraudulent chargebacks may result in legal action under NJ law.

9) Intellectual Property

All content, product designs, text, graphics, logos, and images on this site are owned by S&P or used with permission and are protected by law. You may not copy, resell, or use our content without written permission.

10) User Content (Reviews, Uploads)

If you submit reviews, photos, or other content, you grant S&P a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our business (e.g., on our site or social media). You are responsible for ensuring you have the rights to any content you submit.

11) Third-Party Tools & Links

We may offer access to third-party tools or link to third-party sites. We don’t control those tools/sites and aren’t responsible for their content or policies. Your use of them is at your own risk.

 

12) Disclaimers

We do not guarantee that the site will be uninterrupted, timely, secure, or error-free. Products and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied (including merchantability, fitness for a particular purpose, and non-infringement).

Color & display: We make reasonable efforts to display product colors accurately; actual colors may vary by screen and printer settings.

 

13) Limitation of Liability

To the fullest extent permitted by law, S&P shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or use, even if advised of the possibility. In no event shall our total liability exceed the amount you paid for the product(s) at issue.

14) Indemnification

You agree to indemnify and hold harmless S&P and our officers, employees, agents, and suppliers from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the site or products.

15) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, carrier interruptions, government actions).

 

16) Governing Law; Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree that any dispute will be brought in the state or federal courts located in New Jersey, and you consent to their 

 

17) Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with an updated date. Your continued use of the site after changes means you accept the updated Terms.
